First, we would like to inform you about your rights as a data subject. These rights are defined in Articles 15-22 of the EU GDPR. This includes:

Rights of objection

Please note the following regarding your right to object:

If we process your personal data for direct marketing purposes, you have the right to object to this data processing at any time without giving reasons. This also applies to profiling insofar as it is related to direct marketing.

If you object to the processing of your personal data for direct marketing purposes, we will no longer process your personal data for these purposes. The objection is free of charge and can be made informally, preferably to: datenschutz(at)modusconsult(dot)de.

In the event that we process your data to protect legitimate interests, you may object to this processing at any time for reasons arising from your particular situation; this also applies to profiling based on these provisions.

We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or the processing serves the purpose of establishing, exercising or defending legal claims.

Purposes and legal bases of data processing

Your personal data is processed in accordance with the provisions of the EU GDPR and all other applicable data protection regulations. The legal basis for data processing arises in particular from Article 6 of the EU GDPR.

We use your data for initiating business, fulfilling contractual and legal obligations, executing the contractual relationship, offering products and services, and strengthening customer relationships, which may also include analyses for marketing purposes, customer satisfaction surveys, and direct advertising.

Your consent also constitutes a legal basis for data processing under data protection law. We will inform you about the purposes of the data processing and your right to withdraw your consent. If the consent also relates to the processing of special categories of personal data, we will explicitly inform you of this in the consent form.

The processing of special categories of personal data within the meaning of Article 9 paragraph 1 of the EU GDPR will only take place if this is required due to legal regulations and there is no reason to assume that your legitimate interest in excluding the processing outweighs this requirement.

Disclosure to third parties

We will only disclose your data to third parties within the framework of legal regulations or with your explicit consent. Otherwise, your data will not be disclosed to third parties unless we are legally obligated to do so (disclosure to external bodies such as regulatory authorities or law enforcement agencies).

Recipients of the data / Categories of recipients

Within our company, we ensure that only those individuals who need your data to fulfill contractual and legal obligations receive it.

In some cases, service providers support our specialist departments in fulfilling their tasks, e.g., with newsletter distribution. The necessary data protection agreements have been concluded with all service providers.

Transfer to a third country / Intention to transfer to a third country

Data is only transferred to third countries (countries outside the European Union or the European Economic Area) if this is legally required, if you have given us your consent, or if it is necessary for the performance of the contract. We ensure compliance with the data protection level by concluding the necessary data protection agreements.

Data retention period

We store your data for as long as it is needed for the respective processing purpose. Please note that numerous retention periods require that data be stored for longer periods. This applies in particular to commercial or tax law retention obligations (e.g., German Commercial Code, German Fiscal Code, etc.). Unless further retention obligations exist, the data will be routinely deleted once the purpose has been fulfilled.

In addition, we may retain data if you have given us your permission to do so, or if legal disputes arise and we need to use evidence within the statutory limitation periods, which can be up to thirty years; the regular limitation period is three years.

Secure transfer of your data

To protect the data stored with us as effectively as possible against accidental or intentional manipulation, loss, destruction, or access by unauthorized persons, we implement appropriate technical and organizational security measures. The security levels are continuously reviewed in cooperation with security experts and adapted to new security standards.

Data exchange to and from our website is always encrypted. We offer HTTPS as the transmission protocol for our website, using the latest encryption protocols.

This site uses SSL/TLS encryption for security reasons and to protect the transmission of confidential information, such as inquiries you send to us as the site operator. You can recognize an encrypted connection by the fact that the browser's address bar changes from "http://" to "https://" and by the padlock icon in your browser's address bar.

When SSL or TLS encryption is enabled, the data you send to us cannot be read by third parties.

Furthermore, it is possible to use alternative communication channels (e.g., postal mail).

Obligation to provide data

Various personal data are necessary for establishing, executing, and terminating the contractual relationship and fulfilling the associated contractual and legal obligations. The same applies to the use of our website and the various functions it provides.

We have summarized the details for you in the section above. In certain cases, data must also be collected or provided due to legal requirements. Please note that processing your request or fulfilling the underlying contractual obligation is not possible without providing this data.

Categories, sources and origin of the data

The specific data we process depends on the context.

Please note that we may also provide information separately in appropriate places for special processing situations, e.g. when uploading application documents or when making a contact request.

When you visit our website, your browser transmits the following types of data, which are stored by us:

• the IP address of the accessing computer

• the server requests (e.g. page views) including the time

• the browser type

• the referrer URL (i.e., the address of the previously visited website, if you arrived at our website by clicking on a hyperlink from there)

These first three data types are technically necessary to correctly display the pages of this website you have requested. They can also be used, if necessary, to maintain the secure operation of this website (e.g., to defend against hacking attempts).

The referrer URL is used in anonymized form for advertising statistics purposes. For reasons of technical security (in particular to defend against attacks on our web server), this data is stored for 7 days in accordance with Article 6 Paragraph 1 lit. f GDPR.

As part of our event registration forms, we may collect and process the following data:

For online applications, we may collect and process the following data:

• Your basic personal data (e.g. name, first name, name suffixes, date of birth, title if applicable),
• Qualification and education data (e.g. CV, certificates),

• If applicable, please provide information on your earliest possible start date, regional mobility, desired number of hours and duration of employment, previous employment with MODUS, or information on social engagement.

For technical security reasons, your IP address will also be processed. 

Your personal data is generally collected directly from you during the application process. In exceptional cases, your personal data may also be collected from other sources, such as recruitment agencies.
We also use personal data that we have lawfully obtained from publicly accessible directories (e.g., professional networks like XING and LinkedIn).

To best protect the security and confidentiality of your data, we implement appropriate security measures. Your application documents are transmitted to us in encrypted form via our application system. Our data backup procedures always comply with the latest technological standards.

We store your data during the application process in accordance with applicable law and delete it after a maximum of six months. Data is retained beyond this period only if we are legally obligated or entitled to do so, for example, if you have given us permission to store your data for a specific, longer period or for the purpose of exercising our legal rights.

Regulations that obligate us to retain data can be found, for example, in the German Commercial Code (HGB) or the German Fiscal Code (AO). Statutes of limitations must also be observed. Further information can be found in the data protection declaration within the application process.

We do not use purely automated processing methods to reach a decision.
 

Contact form / Contact via email (Art. 6 para. 1 lit. a, b GDPR)

Our website includes a contact form that can be used to contact us electronically. If you write to us via the contact form, we will process the data you provide in the form to contact you and answer your questions and requests (Art. 6 para. 1 lit. a, b GDPR).

We adhere to the principle of data minimization by requiring you to provide only the data absolutely necessary for us to contact you. This includes your first name, last name, email address, and title. Additionally, your IP address will be processed for technical reasons and legal protection. All other data fields are optional and can be filled in if desired (e.g., to allow us to answer your questions more personally).

If you contact us by email, we will process the personal data you provide in the email solely for the purpose of processing your request.

Zendesk Chat (formerly Zopim)

Subject to your consent, we use the Zendesk service, provided by Zendesk Inc., 1019 Market St., San Francisco, CA 94103, for optimal communication with our customers. The legal basis for this is Article 6(1)(a) of the EU GDPR.

If you have any questions about our products, our website, or anything else, you can send us a message via the Zendesk Chat window. 

All visitors to our pages are recorded along with their IP address and the page they are currently visiting. The IP address is anonymized in the process. Zendesk Chat uses cookies to personalize your online experience with our service.

The information generated by the cookie about your use of our website is transmitted to and stored on a Zendesk server in the USA. For the duration of your visit, we store the ID number and the time you log in in a cookie on your device. 

This cookie allows you to navigate from page to page on our website without having to log in again on each page. If you log out, the cookie will be deleted from your device. Chats are logged and stored on internal servers for 30 days for tracking purposes, after which they are deleted.

Since data is transferred to the USA within this service, there is a risk that your data may be processed by US authorities for control and surveillance purposes, potentially without you having any legal recourse. However, we take all possible and legally required measures in accordance with Articles 44 et seq. of the EU GDPR to ensure an adequate level of data protection in the third country.

You can prevent the installation of cookies by adjusting your browser software settings accordingly; however, please note that in this case you may not be able to fully utilize all the functions of our website.

Newsletter (Art. 6 Para. 1 lit. a EU GDPR)

You can subscribe to a free newsletter on our website. The email address, name, and title you provide when subscribing will be used to send you the personalized newsletter.

The principle of data minimization is observed, as only your email address, salutation, and name are marked as mandatory fields for personalization. For technical reasons and legal protection, your IP address is also processed when you subscribe to the newsletter.

As part of the registration process for our newsletter, we are supported by the service provider Microsoft. A data protection agreement has been concluded with them, as required by law.

You can of course cancel your subscription at any time using the unsubscribe option provided in the newsletter and thus revoke your consent.

Advertising purposes for existing customers (Art. 6 para. 1 lit. f GDPR)

MODUS Consult GmbH is interested in maintaining its customer relationship with you and providing you with information and offers about our products/services, Art. 6 para. 1 lit. f GDPR. Therefore, we process your data to send you relevant information and offers by email and for customer satisfaction surveys.

If you do not wish to receive direct marketing, you can object to the use of your personal data for this purpose at any time; this also applies to profiling insofar as it is related to direct marketing. If you object, we will no longer process your data for this purpose.

Applicant portal (Art. 6 para. 1 lit. a, b EU GDPR)

We offer you the opportunity to apply for specific vacancies or to submit a speculative application via an online application form and to upload your application documents.

We are aware of the importance of your data and process the personal data you provide in the application form only for the purpose of the effective and correct handling of the application process and for contacting you during the application process, Art. 6 para. 1 lit. a, b GDPR. Your data will not be shared with third parties without your consent.
 
The application form asks you to provide personal data. We adhere to the principle of data minimization by requiring you to provide only the data necessary for a complete review of your application documents, such as your CV, or data we are legally obligated to collect. These mandatory fields are marked with an asterisk (*). For technical reasons and for legal protection, your IP address is also processed.

Without this data, we cannot review your application documents; therefore, our application system will not allow you to upload them. Of course, you have the option to provide additional information voluntarily in the application form.

To best protect the security and confidentiality of your data, we implement appropriate security measures. Your application documents will be transmitted to us in encrypted form via our application system.

We store your data for the purposes mentioned above until the application process is completed and any applicable deadlines have expired – at the latest six months after you receive a decision.
 
However, with your explicit consent after the application process is complete, you have the option for us to store your application documents for a longer period and compare them with other vacant positions that match your profile. In this case, we will store your data for 12 months. Cookies (Art. 6 para. 1 sentence 1 lit. a, f EU GDPR, § 25 para. 1, 2 TTDSG)

Our website uses cookies in several places. They serve to make our website more user-friendly, effective, and secure. Google Ads Remarketing

We use the remarketing function of Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) on our website. This function allows us to present users of our website with interest-based advertisements on other websites within the Google advertising network (in Google Search or on YouTube, so-called "Google Ads," or on other websites). For this purpose, user interaction on our website is analyzed, e.g., which offers the user was interested in, in order to display targeted advertising to users on other websites even after they have left our site.

Google Ads Conversion Tracking

On our website, we use the Google Ads Conversion Tracking advertising service from Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland). Your interactions with Google ads are measured via the Display Network, Shopping, and Search ad types active on our site. When you click on one of our Google ads, a cookie is stored in your browser. This cookie tracks your subsequent activity on the product advertised in the ad (conversion tracking). This data allows us to measure the effectiveness of our advertising campaigns. Google Analytics 4

Based on your consent (Art. 6 para. 1 sentence 1 lit. a GDPR), we use Google Analytics 4, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").
Cookies and other technologies that access information from your device are also used. We collect and process the following data:

• Referrer URL (the previously visited page)
• Hostname of the accessing computer (IP address)
• Date and time as well as duration of the visit
• Bounce rates
• Click path

• Downloads
• Location
• Internet service provider

If you give us your consent (Art. 6 para. 1 sentence 1 lit. a GDPR) to data processing by Google Analytics 4, we will use your data for usage analysis. In this case, we will forward the data to Google for evaluation without anonymization or pseudonymization. The information will then be transferred to a Google server in the USA and stored there, as described. However, Google's IP anonymization is active, so your IP address will be shortened before data transfer and within the European Union or contracting states of the European Economic Area. Google does not store the full IP address. Only in exceptional cases will the full IP address be transmitted to Google.

On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics 4.0 will not be merged with other Google data.

Sessions and campaigns always end after a certain period of time. By default, sessions end after 30 minutes of inactivity and campaigns after 30 days. Users' personal data is deleted or anonymized after two months, and cookies have a lifespan of 24 months. In the case of processing based on your consent, Google processes and stores your personal data in the USA. Appropriate contractual agreements and guarantees ensure compliance with the European level of data protection for data transfers and processing in third countries. Data processing and storage in third countries may also be based on your consent (Art. 49 para. 1 sentence 1 lit. a GDPR). In this case, you will be specifically informed of this and the possibility of withdrawing your consent when we obtain it.

You can withdraw your consent at any time with effect for the future. To do so, simply access our consent banner and deselect the relevant consent. Please note that the change in the consent banner settings must be made individually for each device.

Google Tag Manager

This website uses Google Tag Manager from Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland. This service allows website tags to be managed via a single interface. The Tag Manager tool itself (which implements the tags) is a cookieless domain. This means that no cookies are used and no personal data is collected. Google Tag Manager triggers other tags, which may in turn collect data. However, Google Tag Manager does not access this data. If deactivation has been performed at the domain or cookie level, it will remain in effect for all tracking tags implemented with Google Tag Manager.

If you object to one subservice, this objection will automatically apply to all other subservices included in the Google Tag Manager.

Within the scope of these services, the collected data may be transferred to a country outside the European Union and the European Economic Area, and to a country that does not offer an adequate level of data protection. If the data is transferred to the USA, there is a risk that your data may be processed by US authorities for control and surveillance purposes, potentially without you having any legal recourse. However, we take all possible and legally required measures in accordance with Art. 44 et seq. GDPR to ensure an adequate level of data protection in the third country.
 

LinkedIn Insight Tag

We use the LinkedIn Insight Tag on our website, a conversion tracking and retargeting service provided by LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland (hereinafter referred to as "LinkedIn"). LinkedIn stores and processes information about your user behavior on our website. LinkedIn uses cookies for this purpose; these are small text files that are stored locally in your web browser's cache on your device and enable analysis of your use of our website. Specifically, the referrer URL, IP address, device information, browser information, and your timestamp are recorded.

Upon completion of the registration process, your data is stored with Microsoft for use in the secure customer area. As soon as you log in to our website with your email address as your username and password, these login credentials will be used for all actions you perform on our helpdesk and deployment portal.
 
Registered users can independently change their contact information (name, email, phone number, password) in their customer account. Our support team is also happy to make changes/corrections upon request; simply contact them. Of course, you can also cancel or delete your registration or customer account. Project Portal

MODUS Consult GmbH provides its clients with a portal (based on SharePoint) for communication, task coordination, and document management within the framework of projects. All project-relevant documents, meeting minutes, and schedules are stored in this portal and shared with the client. Project portals are created and activated for the client at the start of each project. Client-side access rights are communicated by the client's project manager.

During registration, we store the following data:

The data listed above is required to create your login. To log in, you need an existing Microsoft business account, or you can create a new one during the registration process.
